Please read these Terms carefully. By creating an account or using Minimalite in any way, you agree to be bound by these Terms of Service. If you do not agree, you must not use our platform.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Minimalite ("Company", "we", "us", "our") governing your access to and use of the Minimalite website, platform, and all associated services (collectively, the "Service").
By registering an account, purchasing a subscription or credit pack, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Eligibility & Age Restriction
You must be at least 18 years of age to use Minimalite. By using this Service you represent and warrant that you are 18 or older. The Service may include adult-only (NSFW) content. Access to such content is restricted to verified adult users only.
If we discover that a user is under 18, we will immediately terminate their account and permanently delete all associated data and generated content. We reserve the right to require age verification at any time.
You must also have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access or use of your account.
You may not share your account with others, transfer your account to another person, or create accounts on behalf of third parties without our express written consent. One person may hold only one active account.
We reserve the right to suspend or permanently terminate accounts that violate these Terms, that are used for fraudulent activity, or that we reasonably believe are being operated by someone other than the registered user.
4. Permitted Use
Subject to these Terms, Minimalite grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial creative purposes, in accordance with your active subscription or credit balance.
You may use AI-generated images and videos produced through the Service for personal projects, artistic work, and commercial purposes (subject to your plan's terms). You retain ownership of the specific output generated by your prompts, subject to the restrictions below.
5. Prohibited Conduct
You agree not to use the Service to:
- Generate content depicting minors in a sexual or suggestive manner โ this is strictly prohibited and will result in immediate account termination and reporting to relevant authorities.
- Produce content that incites hatred, violence, or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
- Create non-consensual synthetic media ("deepfakes") of real, identifiable individuals for deceptive or harmful purposes.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or infrastructure of the Service.
- Use automated scripts, bots, or scrapers to access or abuse the Service beyond what is expressly permitted by your plan.
- Circumvent any content filters, rate limits, authentication, or security mechanisms.
- Violate any applicable local, national, or international law or regulation.
- Infringe upon the intellectual property rights of any third party.
Violation of these prohibitions may result in immediate suspension or permanent termination without notice or refund.
6. Generated Content & Ownership
You retain ownership of the creative output (images and videos) generated through your prompts on Minimalite, subject to any applicable laws and third-party rights.
By using the Service, you grant Minimalite a limited, non-exclusive, worldwide license to store, display, and transmit your generated content solely for the purpose of operating the Service โ specifically to display that content in your personal gallery within the platform.
Storage & Deletion Policy: Generated images and videos are stored on our servers exclusively so they can be displayed in your personal gallery. We do not use your generated content for any other purpose. If you delete content from your gallery, it is permanently and irreversibly removed from our servers. We do not retain copies of deleted content. We strongly recommend downloading any content you wish to keep before deleting it from the platform.
You are solely responsible for the content you prompt the system to generate. You represent and warrant that your use of generated content complies with all applicable laws and does not infringe on the rights of any third party.
7. Payments & No-Refund Policy
Minimalite offers both monthly subscription plans and one-time credit pack purchases. All payments are processed securely through our third-party payment providers.
Subscription Plans: Monthly subscriptions are billed in advance on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial-month refunds are issued.
Credit Packs: Credit purchases are final. Credits do not expire and carry over indefinitely, but they are non-transferable and tied to your account.
All purchases are final and non-refundable. We do not offer refunds, exchanges, or credits for any subscription fees or credit pack purchases, except where expressly required by applicable consumer protection law in your jurisdiction. By completing a purchase, you acknowledge and accept this policy.
Prices are subject to change at any time at our sole discretion, without prior notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
If a payment fails, your account may be downgraded or suspended until payment is successfully processed.
8. Service Availability & Downtime
We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, third-party infrastructure failures, or circumstances beyond our control.
Downtime Compensation: In the event of significant and extended service disruption affecting paid subscribers, Minimalite may, at its sole and absolute discretion, offer account credits, subscription extensions, or other compensation. This is entirely at the discretion of Minimalite management and does not constitute a guaranteed right or entitlement. No compensation of any kind is guaranteed for any period of service unavailability, regardless of duration or cause.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we will not be liable to you for any such modification, suspension, or discontinuation.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Minimalite, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever, including but not limited to:
- Loss of data, revenue, profits, or business opportunities
- Damage to your device, software, or data resulting from use of the Service
- Any content generated by AI models that you find offensive, inaccurate, or inappropriate
- Unauthorized access to your account resulting from your failure to maintain credential security
- Actions or content of other users of the Service
- Interruption, suspension, or termination of the Service
- Any third-party claims arising from your use of generated content
In no event shall our total cumulative liability to you for all claims arising from or relating to the Service exceed the total amount you paid to Minimalite in the twelve (12) months immediately preceding the event giving rise to the claim.
You use the Service entirely at your own risk. You are solely responsible for any legal consequences arising from the content you generate, publish, or distribute using the Service.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Minimalite does not warrant that: (a) the Service will function uninterrupted, securely, or without errors; (b) any content generated will be accurate, appropriate, or of a particular quality; (c) any defects or errors will be corrected; or (d) the Service is free of viruses or other harmful components.
AI-generated content is inherently unpredictable. We make no representations about the suitability, accuracy, or legality of any content generated through our models.
11. Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings. Upon termination, your access to the Service will cease immediately, and all generated content stored in your gallery will be permanently deleted.
We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms, suspected fraud, or prolonged inactivity. Termination by us for cause will not entitle you to any refund.
Provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 9, 10, and 12) shall survive termination.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by email or by displaying a prominent notice on the platform. The updated Terms will be effective immediately upon posting unless a different effective date is specified.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion.
